Official Terms and Conditions

1. To Enter:

Beginning Thursday, July 1, 2021 and continuing until Thursday, August 19, 2021 at 11:59:59 p.m. EDT, eligible Massachusetts residents may enter the Massachusetts VaxMillions Giveaway ("the Promotion").
VaxMillions prize drawings will be conducted weekly, for five weeks, with the first drawing on July 26, 2021.

There will be two drawings each week as detailed below.
  • One drawing for Massachusetts residents ages 18 and over; and
  • One drawing for Massachusetts residents ages 12 to 17 years old.
Entrants will be placed in a drawing pool according to their actual age at the time of entry.

Winners will be announced publicly and posted on the VaxMillionsGiveaway.com website and in other promotional materials and announcements following each weekly drawing. Entry deadlines, weekly drawings, and drawing announcements will follow the schedule below. All dates are in calendar year 2021.

In order to participate in the Promotion and be entered in the drawings, an eligible Massachusetts resident must complete an online entry form and provide all required entry information, acknowledgements, and consents.

Entry must be completed through www.VaxMillionsGiveaway.com.

Eligible Massachusetts residents who do not have access to the internet and wish to enter may call the VaxMillions Giveaway Promotion Call Center for assistance. The Call Center may be reached by dialing 2-1-1. Daily call center hours are posted in the FAQ section located at www.VaxMillionsGiveaway.com.

Callers must ask that that they be entered into the Promotion, provide the required entry information, and provide the required acknowledgements and consents.

One entry per person. Eligible Massachusetts residents may only submit one entry into the drawings. An eligible entry submitted before the entry deadline for any weekly drawing will remain entered for all later drawings unless disqualified under these Terms and Conditions. (For example: An entry submitted prior to the Drawing 1 Entry Deadline will be entered for all 5 drawings; an entry submitted after the Drawing 1 Entry Deadline but before the Drawing 2 Entry Deadline will be entered for Drawings 2, 3, 4, 5.)

Participants who have made an error in submitting their entry may submit a subsequent entry to correct errors in the initial entry. Prior to each drawing, the entry list will be reviewed, all duplicate entries will be removed, and only the later submitted entry will be included in the drawing. Persons submitting multiple entries for reasons other than making good faith corrections may be disqualified from the Promotion.

An entrant may only win once during the Promotion. A winner in any weekly drawing will be removed from the entry list and will be ineligible for all future drawings.

All information submitted by participants will be maintained under the terms of the VaxMillions Giveaway Promotion Privacy Policy, which is available here: www.mass.gov/vaxmillions-privacy-policy

2. Eligibility
You are eligible to enter the Promotion and participate in the drawings only if you meet all the following requirements at the time of entry and the time of any potential prize award:
  1. You are a living, legal permanent resident of the Commonwealth of Massachusetts, which means that you make your primary home and legal residence in Massachusetts and you are a U.S. citizen or are otherwise residing in the U.S. in conformity with Federal immigration laws.
  2. You are at least 12 years of age.
  3. You have received the full required regimen of vaccine doses as specified by the FDA:
    • If you are receiving the Pfizer or Moderna vaccine, you have received both doses of the vaccine
    • If you are receiving the Johnson & Johnson vaccine, you have received the one required dose of the vaccine
    To satisfy this requirement, you must have received your second dose of either Pfizer or Moderna or a single dose of Johnson & Johnson on or before the day you register for the drawing. Entries submitted earlier than the day on which the registrant completes all required doses of vaccination are not qualified to win.
  4. You received your full required regimen of COVID-19 vaccination in the Commonwealth of Massachusetts OR
  5. for military veterans only: you received your full required regimen of vaccine doses either in the Commonwealth of Massachusetts or at any VA hospital or VA clinic (a hospital or clinic operated by the United States Department of Veteran’s Affairs) located in any State.
  6. You are not an employee or officer of the Massachusetts Lottery Commission or the Massachusetts Governor’s Office or an immediate family member (spouse, domestic partner, child, parent, parent-in-law, or sibling) who resides in the same household as such an officer or employee.
  7. You are not an officer, contractor, or employee who assisted in the development or administration of this Promotion, or an immediate family member (spouse, domestic partner, child, parent, parent-in-law, or sibling) who resides in the same household as such an officer, contractor, or employee.
  8. You are not incarcerated (in a prison, jail, house of correction, or other penal institution) for a criminal offense or confined in a detention center under the laws of this state, another state, or the United States.
3. Weekly Prizes
Massachusetts VaxMillions Drawings - Massachusetts Residents Age 18 and Over

One $1 million cash prize weekly

Massachusetts VaxMillions Drawings - Massachusetts Residents Ages 12 to 17

One $300,000 scholarship award weekly. The scholarship will be provided in the form of a contribution to a 529 College Savings Plan administered by the Massachusetts Educational Financing Authority (MEFA) and managed in partnership with Fidelity Investments.

Funds in the 529 plan will be available for application to tuition, room and board, and related expenses at any college, university, or technical or trade school or other post-secondary educational institution of the winner’s choice, provided the institution is eligible to participate in a student aid program administered by the U.S. Department of Education. Funds will remain available to the prize winner for qualified expenses until age 28.

A winner who is disabled in the meaning of the Federal ABLE statute may elect to receive, in lieu of the scholarship prize, an equivalent financial award to be held by MEFA in a special needs trust or Federally qualified ABLE account to cover qualified expenses.

Winners will be notified of the specifics of each program and its accompanying terms and conditions at the time of the prize award.

4. Drawings

The winners of each weekly drawing will be randomly selected by the Massachusetts State Lottery (MSL) from among all eligible entries received before the deadline for entry associated with that drawing. The Massachusetts State Lottery will use a random number generator (RNG) to conduct the selection.

Each completed and valid entry will be retained in a secure database controlled by DPH and its agents and contractors working at the direction of or in consultation with DPH and assigned an anonymous numerical identifier. For each weekly drawing, MSL will use the RNG to randomly select a group of numbered entries from the database. The group of numbered entries will include one potential winner plus a number of alternates. DPH and its agents and contractors will not provide MSL with any personally identifying information about any entrant as part of the random selection process.

DPH will contact the entrant whose numerical identifier is selected as the potential winning number after determining from its preliminary review that the potential winner appears eligible to win a prize. In the case of a 12 to 17 year old, DPH will contact the potential winner’s parent or guardian as part of its review process. A parent or legal guardian must approve a potential prize award to and validate information submitted by any minor child or any adult under a guardianship when the individual is selected as a potential winner.

A potential winner may be required to verify vaccination status and other information confirming eligibility before being named as an Official Winner.

All Official Winners will be required to complete a VaxMillions Giveaway Claim Form from MSL as a condition of claiming a prize. The Claim Form will require an Official Winner to attest to all eligibility criteria under these Terms and Conditions. An authorized and legally responsible parent, guardian, or conservator will be required to complete the Claim Form on behalf of an Official Winner who is a minor or a person otherwise not competent to complete the claim form.

5. Verification

The Massachusetts Department of Public Health (DPH) and the Massachusetts State Lottery (MSL) will review and attempt to confirm potential winner information and eligibility prior to declaring an Official Winner for each prize.

Verification of all information and eligibility criteria must be established to the sole satisfaction of DPH and MSL before a potential winner is named an Official Winner or entitled to claim any prize.

Any information submitted at the time of entry for or by a minor child or an adult under a guardianship must be verified by a parent or legal guardian prior to designation of such a participant as an Official Winner and award of a prize. The completed entry form for Massachusetts residents ages 12 to 17 years old must include a parent or legal guardian’s information, including their name, address, telephone number and email address.

All participants who complete the online entry form and enter the drawing are explicitly authorizing DPH to access their Massachusetts Immunization Information System (MIIS) vaccination records to verify that the participant has received a complete COVID-19 vaccination.

A participant 18 years or older who is selected as a potential winner will be contacted by a DPH representative to initiate the verification process. The parent or guardian of a participant who is 12 to 17 years old and selected as a potential winner will be contacted by a DPH representative to initiate the verification process. DPH will use the contact information provided by the participant at the time of registration to initiate contact by telephone, text message, and email.

DPH must speak by telephone with a potential winner or potential winner’s parent or guardian, as applicable, to verify the potential winner’s eligibility to win.

Required Telephone Response: A potential winner or the potential winner’s parent or guardian, for participants 12 to 17 years old, will have 24 hours from the time DPH sends its initial telephone, text message, and email communication to respond to DPH. A potential winner or the potential winner’s parent or guardian must respond by contacting DPH by telephone within the 24 hour period and at the telephone number provided in the DPH communication. If the potential winner or the potential winner’s parent or guardian does not respond by making telephone contact with DPH within 24 hours and as instructed, the potential winner will forfeit the chance to win any prize and DPH will select an alternate as the potential winner.

The burden of demonstrating vaccination and eligibility on other criteria in a timely manner and to the satisfaction of DPH and MSL rests with the potential winner. This burden extends to obtaining documents and records necessary to establishing eligibility.

Absence of Vaccination Record in MIIS. If there is no vaccination record for the potential winner within the Massachusetts Immunization Information System (MIIS) or if DPH cannot match any record within MIIS with the potential winner, DPH will make reasonable efforts to confirm a potential winner’s vaccination status based on information the potential winner (or the potential winner’s parent or guardian) provides to DPH at the time of initial contact. DPH will not validate a potential winner’s vaccination status without either (a) identifying a confirmatory record of vaccination within MIIS; or (b) directly and independently verifying vaccination with the health care provider that administered the vaccination.

A potential winner may be required to submit a release form to authorize a health care provider to provide the potential winner’s vaccination information to DPH. A potential winner may also be required to obtain a signed affidavit or similar affirmation from the provider the administered the vaccination in order to verify the potential winner’s vaccination status.

DPH will have engaged in reasonable efforts to confirm a potential winner’s vaccination status where DPH makes at least 3 attempts within 36 hours to contact a provider identified by the potential winner. If within this 36 hour period DPH is unable to confirm the potential winner’s vaccination to DPH’s sole satisfaction or if DPH concludes at any time that the potential winner’s vaccination cannot be verified, DPH may declare that the potential winner is ineligible and an alternate may be awarded the prize.

A potential winner who is determined by DPH to be eligible to win will be required to provide proof of identity and residency to MSL and to affirm eligibility on all other eligibility criteria prior to being declared an Official Winner. MSL will provide a potential winner with electronic or other means for establishing such proof in a timely manner and in any case prior to the scheduled Announcement Date for the drawing in question.

In the event that DPH or MSL determines at any point that a potential winner’s entry is invalid or ineligible, or if DPH or MSL are unable to contact a potential winner (or the potential winner’s parent or guardian in the case of participants 12 to 17 years old) or unable to validate the winner’s eligibility based upon information provided by the potential winner or his or her parent or guardian, or if a potential winner does not wish to receive a prize, or refuses or fails to provide verification information satisfactory to DPH and MSL, or if a potential winner or his or her parent or guardian does not respond to the initial contact by DPH or otherwise does not provide information required to verify eligibility within the timelines set by DPH and MSL, DPH and MSL may deem the potential winner ineligible and the potential winner will forfeit any claim to prizes associated with the Promotion. DPH and MSL shall then select the next ranked alternate potential winner from among the alternates and commence the verification and confirmation process with the newly selected potential winner. Alternate winners shall continue to be selected in the same manner until an Official Winner for the drawing has been confirmed.

DPH and MSL will have a limited period of time to locate and verify the eligibility of potential winners due to the fixed weekly schedule for drawing and announcing Official Winners. The decision to deem a potential winner ineligible or finally to declare an Official Winner shall be at the sole discretion of DPH and MSL. A decision by DPH and MSL to declare a participant ineligible or disqualified for any reason shall be final and not subject to appeal.

Once DPH and MSL have to their own satisfaction confirmed a potential winner’s eligibility and compliance with these Official Terms and Conditions, DPH and MSL will declare a potential winner to be an Official Winner of the VaxMillions Giveaway.

6. General Rules

Persons who do not meet the eligibility requirements defined in these Official Terms and Conditions are not eligible to enter or to win. By participating in the Promotion, all entrants agree to be bound by these Official Terms and Conditions, all final decisions of DPH and MSL, and all procedures established for the Promotion.

All prizes must be claimed at the MSL Headquarters Office, located at 150 Mount Vernon, Dorchester, MA. An Official Winner must claim his or her prize by completing a VaxMillions Giveaway Promotion claim form in person at the MSL Headquarters Office within 60 days of being announced as an Official Winner of the Promotion.

In the event of an Official Winner’s death or inability to claim or receive a prize, DPH and MSL will in their sole discretion determine how and whether to award the prize.

DPH and MSL may void any Drawing without advance notice and conduct a new Drawing if DPH and MSL, in their sole discretion, determine it is necessary to maintain the integrity of the Promotion.

Entry deadlines, drawing dates, and announcement dates for the Promotion are subject to adjustment.

Publicity of Winners. An Official Winner’s participation in the Promotion and acceptance of the prize constitute the Official Winner’s express permission for the Commonwealth of Massachusetts and its agencies to use his or her name and likeness for advertising and promotional purposes, without compensation. This same permission is granted by one executing documents necessary to the award of a prize on behalf of an Official Winner who is a minor or under a disability which prevents the Official Winner from executing such documents on his or her own behalf. Further, by accepting a prize, each Official Winner agrees to hold the Commonwealth of Massachusetts and its agencies, employees, commissioners, owners, directors, officers, affiliates, subsidiaries, contractors, assignees and agents, harmless against any and all claims or liability arising out of the Official Winner’s participation in the Promotion and receipt and ownership or use of a prize.

State Obligations of Official Winners. If you win a prize and owe any State Obligations, then the prize will be applied first to your unpaid State Obligations. For Official Winners 18 years of age or older, the total amount of the prize, less tax withholdings and any State Obligations, will be issued to you. “State Obligations” includes, but is not limited to, child support and debt owed to a State agency or other State or local governmental agency.

Taxes. Official prize winners are responsible for all taxes, including income taxes. Official Winners 18 years of age or older will receive a W-2G form from MSL reflecting the value of their prize. All amounts or values paid to an Official Winner or paid on the Official Winner’s behalf will be included in the taxable income that is reported on the Official Winner’s W-2G form and the Official Winner will be taxed on those amounts. The minimum required Federal and State taxes will be withheld from all prizes awarded to Official Winners 18 years of age and older.

Each Official Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in the Promotion or use or redemption of any prize. The Commonwealth of Massachusetts and its agencies make no warranty, guarantee or representation of any kind concerning any prize (or any portion thereof) and disclaims any implied warranty.

Internet Conduct and Limitations of Liability. Any attempt by a user, participant or any other individual to deliberately damage the Promotion website or undermine the legitimate operation of this Promotion, is a violation of criminal and civil laws. A person engaging in such conduct may be disqualified from the Promotion without notice and may face criminal prosecution or civil liability as permitted by law.

The Commonwealth of Massachusetts and its agencies, employees, commissioners, directors, officers, affiliates, subsidiaries, contractors, assignees or agents are not responsible for late or incomplete or misdirected participant entries, or for incorrect, inaccurate or incomplete information associated with such entries, even if caused by failures in the entry website or online entry form, or by any of the equipment or programming associated with or utilized in this Promotion.

The Commonwealth of Massachusetts and its agencies, employees, commissioners, directors, officers, affiliates, subsidiaries, contractors, assignees and agents are not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, or communication failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Promotion, which may include without limitation, inaccessibility or unavailability of the internet, the entry website or online entry form or any combination thereof; theft or destruction or unauthorized access of the website or the database of entries; any injury or damage to the participants or to any other person's computer(s) or smartphone related to or resulting from participating in this Promotion, or downloading materials from or use of the website.

All materials submitted by participants in connection with the Promotion become the property of the Commonwealth of Massachusetts and will not be returned. Prizes are nontransferable to any entity or other person, including relatives or friends.

The Commonwealth of Massachusetts, in its sole discretion, reserves the right to select or change the prize(s) to be awarded as part of this Promotion or end the Promotion prior to all prize winners being drawn.

If any discrepancy exists between these Official Terms and Conditions and other statements or materials or advertisements concerning the Promotion, these Official Terms and Conditions shall prevail.

These Official Terms and Conditions are subject to review and may be amended or revised at any time at the sole discretion of the Commonwealth of Massachusetts.
